LAND USE ORDERS OF THE DIRECTOR
By authority conferred on the
Director of the Department of Natural Resources by Section 504 of Act No. 451
of the Public Acts of 1994, as amended, being section 324.504 of the Michigan
Compiled Laws and in accordance with R 299.671 and R 299.922 of the Michigan
Administrative Code, the Director of the Department of Natural Resources orders
that the following order of the Land Use Orders of the Director shall read as
follows:
Chapter I - Definitions and
General Provisions
1.1 Title.
Order 1.1. These orders shall be known and may be cited as the
"Land Use Orders of the Director."

1.2 Definitions.
Order 1.2. As used in these orders:
(1) "Alcoholic beverage"
means any spirituous, vinous, malt, or fermented liquor, liquids and
components, except over-the-counter and prescription medications, containing ½
of 1 percent or more of alcohol by volume that are fit for use for beverage
purposes.
(2) "A.N.S.I." means
American national standards institute.
(3) "ATV" means an
all-terrain vehicle as defined by section 1 of Act No. 319 of the Public Acts
of 1975, being §257.1601 of the Michigan Compiled Laws.
(4) "Camp" means the
erection of a tent; the opening or setting up of a tent-type camper; the
parking and occupancy of a travel or house trailer; sleeping in any type motor
vehicle, sleeping bag, or in any other manner after 10:00 p.m.; and for the
purposes of chapter II of these orders shall also include sleeping in an
anchored, tied, or moored boat or floating craft of any type in waters
immediately offshore of state-owned public access site lands after 10:00 p.m.
(5) “Commercial operations” means
any activity which involves the buying or selling of goods or services, or the
exchange or attempt or offer to exchange goods or services for money, barter,
or for anything of value.
(6) "Commission" means
the natural resources commission.
(7) "Department" means
the department of natural resources.
(8) "Designated area,"
"designated route," or "designated trail" means those
places as defined by R 299.334 of the Michigan Administrative Code that are
signed on-the-ground for ORV use.
(9) "Fireworks" means a
device as defined by section 243a of Act No. 328 of the Public Acts of 1931,
being §750.243a of the Michigan Compiled Laws made from explosive or flammable
compositions.
(10) "Holiday" means
Memorial day, July 4 and Labor day, as defined by section 1 of Act No. 124 of
the Public Acts of 1865, as amended, being §435.101 of the Michigan Compiled
Laws.
(11) "Labor day" means
the first Monday in September as prescribed by section 1 of Act No. 124 of the
Public Acts of 1865, as amended, being §435.101 of the Michigan Compiled Laws.
(12) "Motor vehicle" or
"motorized vehicle" mean every device in, upon, or by which any
person or property is or may be transported if that device is propelled by an
energy source other than muscle or wind.
(13) "ORV" means an
off-road vehicle as defined by section 1 of Act No. 319 of the Public Acts of
1975, being §257.1601 of the Michigan Compiled Laws.
(14) "Posted" means that
signs have been placed by the department that provide a person reasonable
notice of the provisions of an order of the director.
(15) "RA" means
recreation area.
(16) "SGA" means state
game area.
(17) "SP" means state
park.
(18) "Vessel" has the
same meaning ascribed to that term in the marine safety act, Act No. 303 of the
Public Acts of 1967, being sections 281.1001 to 281.1199 of the Michigan
Compiled Laws.
(19) "WA" means wildlife
area.
(20) "Wheeled motorized
vehicle" means a motor vehicle propelled by wheels in contact with the
substrate supporting the weight of the vehicle.
(21) "WSP" means
wilderness state park.

Order 1.3. As provided by section 3a of Act No. 17 of the Public Acts
of 1921, as amended, being §299.3a of the Michigan Compiled Laws, these orders
shall take effect upon being posted.

2.104 Transient berth occupancy,
storage of items, fires, dock usage, fishing, prohibited behaviors, obstruct
passage of others, repairing vessel, use of bicycles and motorized vehicles,
slip occupancy, mooring at, rafting off dock, dockage fees, commercial use of
mooring facility, advertising sale of boat; use of skate boards, roller skates
and roller blades, and camping at certain facilities, prohibited conduct.
Order 2.104 A person shall not do any of the
following:
(1) Occupy a transient mooring
berth for more than 7 consecutive days without an absence of 48 hours or more
before the next period of occupancy commences; store supplies or accessories on
a dock structure; make alterations to a dock structure; ignite or maintain a
fire for cooking or any other purpose on a dock structure; use a dock structure
for the purpose of diving, jumping, swimming or bathing; swim, dive or bathe in
the water adjacent to a dock structure unless such swimming, diving or bathing
is done in an area specifically maintained for such activity and the area is
designated by the appropriate buoys; fish at or on any finger pier, on any
fueling or service area, or any other dock area when posted against such use;
engage in any violent, loud, boisterous, vulgar, lewd, wanton, obscene, or
otherwise disorderly conduct; obstruct the free passage of other persons; make
major repairs on a vessel except by the permission of the dock master; operate
a bicycle or motorized vehicle on or over the dock structure or sidewalks except
by the permission of the dock master; occupy a slip contrary to the
instructions of the dock attendant; moor at or raft off of a state dock without
having paid the dockage fees authorized by the commission for such use of the
facility; use the mooring facility for commercial purposes without proper
written permission; or advertise for sale any watercraft unless the watercraft
is regularly used for recreational purposes by the owner, within the premises
of any of the following state-owned lands:
(a) Au Gres
mooring facility, Arenac county.
(b) De Tour mooring facility,
Chippewa county.
(c) Whitefish Point, Chippewa county.
(d) Port
(e) East Tawas mooring facility,
Iosco county. In addition, a person shall not use a

Chapter III - State Game and
Wildlife Areas
3.1 Managed state game areas and
wildlife areas, prohibited conduct.
Order 3.1. A person shall not do any of the following on the managed
state game areas and wildlife areas designated in section 13.1 of the wildlife
conservation act order:
(1) Construct a shooting pit or
permanent blind.
(2) Occupy any hunting zone, area,
post, or blind, other than designated on the permit issued to them by the
department.
(3) Park outside of designated
parking areas or on areas posted against such use.
(4) Have on their person, or carry
into the area posted "State Game Area -Hunting by Permit Only," any
metal or glass beverage container commonly used to contain juices, soft drinks,
or an alcoholic beverage, but excluding "thermos type bottles" during
the period September 1 through January 1.
(5) Camp or attempt to camp on
designated parking areas or on any lands posted "State Game Area - Hunting
by Permit Only" during the period October 1 to the end of the migratory
bird season, excluding fish point WA, Tuscola county, unless authorized by the
director.
(6) Operate or use an amphibious or
all-terrain vehicle or any other motor-driven vehicle in any area posted
"State Game Area - Hunting by Permit Only," or any area posted
against such use, except for vehicles authorized by the department.
(7) Fish in any area posted against
such use.
(8) Operate a motorboat at other
than a safe, no-wake speed, or in any area posted against such use, in those
managed hunting areas listed below and posted "State Game Area - Hunting
by Permit Only":
(a) Fish point WA
(b) Nayanquing

centerfire rifle.

(3) Target, trap, or skeet shoot.
(4) Use skis from November 1

(5) Enter the observation deck,
walking, and parking area located in the SE¼ of the SE¼ of section 28, T8N R10W,
from ½ hour after sunset to ½ hour before sunrise. This prohibition does not
apply to department personnel or authorized construction company personnel
performing official or department authorized duties.
(6) Operate a bicycle of any kind,
from September 15 through January 31, on the area, including roads and trails,
unless designated open to bicycle use.
