What are the criteria used by the State Treasurer or his designee and MEGA in deciding whether or not to approve an application?
 
Answer:

The State Treasurer or his designee, as well as MEGA, will use the following criteria in approving or denying an application. The State Treasurer must give priority to projects on a facility (contaminated property).

  1. The overall benefit to the public. (e.g. increased tax revenues, jobs, personal income, neighborhood revitalization, etc.)
  2. The extent of reuse of vacant buildings and redevelopment of blighted property.
  3. Creation of jobs.
  4. Whether the eligible property is in an area of high unemployment.
  5. The level and extent of contamination alleviated by the qualified taxpayer's eligible activities on the project site.
  6. The level of private sector contribution. (e.g. forgoing a local property tax abatement to increase the local tax capture on the project, making a financial contribution to a Downtown Development Authority to increase parking near the project, etc.)
  7. The cost gap that exists between the site and a similar greenfield site as determined by MEGA.
  8. If the qualified taxpayer is moving from another location in this state, whether the move will create a brownfield.
  9. Whether the financial statements of the qualified taxpayer indicate that it is financially sound and that the project is economically sound.
  10. Any other criteria that MEGA or the Treasurer considers appropriate.

The decision to approve or deny a petition to amend a project will be based on the same criteria.
