Will information submitted with an application be available to anyone who requests it?
 
Answer:
The SBT is administered under the Revenue Act. (MCL 205.1-205.30) The department is prohibited from disclosing to any person except the taxpayer or its authorized representative any facts or information obtained in connection with the administration of the tax. Nothing submitted with an application will be disclosed to anyone other than the taxpayer or its authorized representative.

The information submitted with an application to MEGA is generally subject to disclosure under the Freedom of Information Act and the decision to approve a project will be made at a public meeting of MEGA. Applicants may apply for an exemption from disclosure of "financial or proprietary information." "Financial or proprietary information" means information that has not been publicly disseminated or is unavailable from other sources, the release of which might cause the applicant significant competitive harm.
